Oli’s appointment as PM challenged in the court

A writ petition has been filed at the Supreme Court by three advocates challenging the appointment of Prime Minister K.P. Sharma Oli by President Ramchandra Paudel as per Article 76-2 of the Constitution of Nepal.

Advocates Deepak Adhikari, Khagendra Prasad Chapagain and Shailendra Kumar Gupta have filed the writ at the Supreme Court seeking to annul the appointment of Oli as the Prime Minister, according to Supreme Court officials.

They have argued that the President should call for formation of a new government under Article 76-3 if a government formed as per Article 76-2 fails the floor test in the House of Representatives.

The apex court has set July 21 as the date for preliminary hearing regarding the case. President Paudel on Sunday appointed Oli as the Prime Minister after Oli submitted signatures of 165 members of the House of Representatives to the President on Friday. The president had called political parties to form a new government under Article 76-2 after Prime Minister Pushpa Kamal Dahal “Prachanda” lost vote of confidence at the HoR.
